I Saw an Advertisement for a $295 Trademark Registration. How Can I Tell if It’s Legitimate?
It takes roughly 8-10 hours of work to perform a knockout search, evaluate the results of a full mark search, draft a clearance letter, prepare specimens of use, and file a trademark application, all the while, keeping the client apprised of progress. It’s not likely that anyone who offers to register a trademark application for $295 is actually going to take the time properly to clear and file it. Either the attorney is working for $30-$35 per hour, outsourcing the work to low cost labor in India, or not doing the work. Given that most reputable attorneys charge $250 or more an hour (varying by geography), you should not expect very much out of a bargain basement service. Is it possible that your mark will be properly cleared and filed? It’s possible, however, there is also a good chance that there will be problems with the application. We have been retained several times to clean up the mess left behind by these types of sites. One misfiled an application, then filed a fraudulent specimen of use with the PTO to cover it up. The same service missed a filing deadline, causing another application to lapse. These services provide little attention to detail, and are built for volume. They’re no bargain, and upsetting to trademark attorneys who actually care about their clients and know what’s involved in a trademark clearance and registration. There are other options available for clients who are working on restricted budgets.
